A new state law enacted this summer will soon require all counties and cities in North Carolina to subject all applicants for positions that require working with children in any way to criminal history record checks conducted by the North Carolina State Bureau of Investigation (SBI). These new requirements will become effective October 1, 2025. Information regarding the new state law is on the following pages.
It is recommended that the following be included in the Rutherford County Personnel Policy.
Section 3. Recruitment, Selection and Hiring

Required Criminal History Record Check. Pursuant to N.C. Gen. Stat. 153A-94.2(b), before a commitment is made to any applicant for a position that requires work with children in any capacity, the County must conduct a criminal history record check by the North Carolina State Bureau of Investigation in accordance with N.C. Gen. Stat. 143B-1209.26. Any offer of employment of the position to the applicant must be conditional pending the results of the criminal history record check required herein. For the purposes of this section, “children” shall be defined as persons under the age of 18 years and is not married, emancipated or a member of the Armed Forces.
